What is nighttime additional?
The nighttime bonus was created by article 73 of the Consolidation of Labor Laws in 1943.
It determines that people who work at night must have an increase in their monthly salary.
The aim is to bring a benefit to people who face early morning work routines and will become exhausted in their duties.
Therefore, if you work in supermarkets, stores or any 24-hour business, you should receive this benefit.
The same goes for workers who carry out their activities at night in different companies.
Finally, it is worth mentioning that a night work day can last a maximum of 7 hours, unlike day work which lasts up to 8 hours a day.
Therefore, every 52 minutes and 30 seconds, a person who works at night receives the equivalent of 1 hour's salary plus the bonus for working at night.
Who is entitled to the benefit?
As stated earlier in this text, people who work at night are entitled to nighttime pay.
This benefit must be provided to all employees with a formal contract who are at work during this period, regardless of their area or function.
Finally, we need to highlight that self-employed professionals or people who work as MEI do not have access to this additional benefit.
What are the night shift hours?
Did you know that night work hours change depending on the area in which a worker works?
For example: people who work in the city are entitled to nighttime pay if they are at work between 10 pm and 5 am the next day.
On the other hand, those who work in the field have different schedules!
Therefore, those who work on crops between 9 pm and 4 am the next day gain these benefits! The same goes for those who work with livestock between 8 pm and 4 am the next day.
Finally, professionals in the port area also have different hours for night work. They earn additional if they are working between 7 pm and 7 am the following day.
What is the additional percentage?
As in the previous case, the value of the nighttime bonus also changes depending on where a person works.
Therefore, professionals in companies and businesses in the city or urban areas receive 20% more in their salary per hour worked.
On the other hand, employees who work in the field, on crops or with livestock, earn 25% more in their pay for each hour worked at night.
How is the nighttime surcharge calculated?
It’s important to know how to calculate the nightly premium! This way, an employee can check whether they are receiving the benefit correctly.
At the same time, if you realize that payment has not been made, you can sue the employer to receive your rights.
Therefore, to start making this calculation you need to know how much you earn per hour. If you don't already know, simply divide your full salary by the number of hours worked.
Then, simply multiply the amount paid for your hourly work by 0.2. The result will be your bonus.
Finally, add this amount to each of your hours worked at night to know how much you should receive.
How can I check the payment of this additional amount?
Are you in doubt whether the payment of your nightly allowance is being made correctly? Therefore, it is possible to follow some tips to resolve these doubts.
Firstly, ask your superiors what the company pays for your hourly rate. This way, it will be possible to carry out the calculations above and check whether the payment is correct.
At the same time, it is also possible to chat with employees in the same position who work during the day! Find out if their pay is below that of professionals who work at night.
Finally, remember that minors cannot work at night according to Brazilian Labor Laws!
Therefore, if you are looking for a job and are not over 18 years old, you will not be able to count on the nighttime bonus.
However, don't be sad! The young apprentice is also entitled to a series of other benefits! Read the text below if you want to know more about this topic.
